i have no clue what's goin on anymore....seems like a bug or something. changing to dynamic didn't work on my end, but if i copy the working one into the fla i'm working on, then everything's fine. ...

so instead of making the picture the button, i made the text the button and added a layer in the button state which changes the opacity of the picture....
