photoshop pen problems

okay i am using ps7 and i am using the pen tool, the problem is when i try tracing an image to do a clipping path the pen tool colors in the traced part because there is a vector mask i believe, how do i make it to where it doesnt have that similar to the picture shown here

check if you are using the second button on the options palette (paths). If you wish then to apply a fill, menu layers->new fill layer...
