as far as cracking for personal use goes: while it is nice if "you" can listen to your own cd's, it would be more interesting if someone (e.g. a band who made some demos) could have many people listen to their cd's ... so eventually people who find out how to bypass DRM will publish their recipes; this is certainly considered illegal)
If you consider windows with a DRM rather than the xbox: there is a user agreement..
As far as music is concerned: in the old days a band would tape some sessions in the garage and duplicate those audio tapes ... or it would go to an expensive studio for a professional demo
Nowadays we have hardware and software and knowledge so everyone can do good demos and send them out
In the future audio tapes will go out of business, and DRM is on the way in. Maybe once again a professional studio could help (doing the copyrights stuff as well) - with one important difference: a "central authority" could decide that some already copyrighted music is no longer welcome, and install new software on your computers that refuses to play this specific music. This means that the music industry, along with microsoft, could indeed control content. No more independent music - we finally got the thought police.
As far as other software is concerned: the wording of the agreement allows them to mess around with non-windows partitions on your computer. You know that microsoft considers Linux to be the biggest threat to their success.

One final comment regarding Mr Hollings: I wish he could experience just ONE day where ALL computers that do not have built in DRM would just stop to deliver the services he is used to ... this includes computers in the local power plant that make it supply electricity, systems in the car that are necessary for economic driving, computers at the telephone company, computers in his dishwasher, even computers that bring his electoral campaign to the web

I'd actually like to see them try to prosecute for altering your own machine, if you only used it to play 100% legal media. Isn't the US one of the most strident on not surpressing civil liberties? Wouldn't making changes to your own belongings infringe on these civil liberties?Quote:

When I was talking about reverse-engineering, I was talking about those people who make a living out of mod-chipping.
If policeware is started to be included in hardware, people will just try to rmeove it harder. It'll just be like over-clocking the newer cpus. Take Windows XP's anti-crack measures, they were cracked before XP was out to the public.
Both the DMCA and this bill do exactly that. The civil liberty groups have been asleep at the wheel. It will take some higher publicity cases besides the DeCSS case to wake people up to the fact that our civil liberties are slowly being chipped away buy these groups.Quote:

This idea of slapping 'Big Brother' chips on machines slants of a modern day MacCarthyism. If you lean a little left, then your're a pinko communist, and if you have a computer, well of course, you must be pirating software, running pirated software, and most probably, you're also running a massive illegal music swapping service as well (I am, aren't you??). Guilt before innocence, throw away the key.
Isn't the big point being missed here? It's their product that's being ripped off, so isn't it their reponsibility to protect, rather then to attempt to introduce some unenforceable regime of 'spy chips'? I mean, shouldn't the product be controlled and not the user?
The fact that any and all product protetection methods have so far failed doesn't mean that the computer users' rights should infringed upon.

Sorry, johnie, no can do - I'm English, so my signature just ain't worth that much (nobody cares if you don't pay tax!). But I think that you can be guaranteed that I'm not the only brit backing your fight against this, yet one more blatant infringement against civil liberties.
You've probably noticed that what happens in the US, computerwise, ends up everywhere else eventually.

Who are these idiots who get into Congress and then put forward a bill like this? You only need high school level political science to see the problem precedents which could be set by allowing this to happen.
What are they thinking? How much is Microsoft guaranteeing them for passage of the bill? Is it just me, or does the act of getting voted into Congress strip the last shred of hope from otherwise straight-thinking individuals?

Even if this had nothing to do with my sphere of influence (I say sphere of influence, 'cause if I have no influence at my machine for 12-14 hours a day, where do I have influence), there is a strong moral dilemma about what is being threatened; can big business buy its way into additional profit at the expense of its customers?

i have to agree with huricane, i especially liked the way you have expressed fluently the idea that the failure to protect there product should not provide manufactures with the right to track our use of pcs.
that said, take a step back, and look at the amount of piracy that has invaded our everyday lives. The anominity of the web has had some surprising results. one of these has been theft on a huge scale. music, games, other software. thats a hell of a impact on modern life. larceny in most connected houses.

Trust me on this: Companies actually COUNT on piracy. Yes... They REALLY do.
Here is why. A legit version of Photoshop costs around $400 US, give or take. For the average kid wanting to learn design - that is WAY out of their budget.
Knowing full well this demographic could never afford the software, would Adobe just want to cater to designers with more capital ?? NO!!!
Adobe puts out software knowing at least 30% of the people who use it are pirates. They do this because they know that many of these users will someday work in professional studios and/or their own business, at which point they will be required to get legal.
I dont know - I realize this sounds like I am justifying piracy. For the record, I am not. I am just saying - Adobe COUNTS on it so people can LEARN their software. Later on, when they are working professionals - they will have no quams about paying for software they have come to find so useful.
IMO, its like a drug dealer giving you your first few hits for free.. you get hooked and have no reservations for paying next time..
Think I am wrong? How many idiots have no doubt tried to register a pirated copy of Photoshop? Or how about call the 1 800 tech support with a phony serial number.. Have they been prosecuted? Have they been jailed??

look at the damage being done to the music industry.
the movie industry is starting to hurt with all the DVD ripping that is being done in the rental market.
small software companies feel the pain as well.
It is different to include piracy as a cost and include it in the total ticket sale, than suggest that software companies provoke and or incourage pricacy so that as learners turn into pros they convert to legal software.
i know a lot of studios in spain. Many have no legal software at all. none. zip. So i challenge your theory that from student to pro there is a change of attitude to the use of illegal software.
In fact I would argue that those students that have used illegal software are more likely to continue to do so in there pro phase than students have not used illegal software.
This leads to another question.
¿ anyone know of a student that has not used illegal software?

actually i own an x-box, and i've copied over 100 songs from my computer that were in mp3 format to the xbox.
so far i havn't been able to get it to read a cdr, but it will read most cdrws just fine.
so i burn an audio cd with nero or easy cd, then put it into the xbox and copy the songs.
it works fine.

Now, I know your argument stems more from the sales of albums, but being that I have worked in the music industry - I can tell your first hand - although there is harm done - there is more good to come of it. In many cases, a user who listens to a random MP3 on the internet (who'd otherwise NOT pay $16 only to find out the album is junk) will be MORE inclined to buy the album because he/she has heard the material.
Plus, concerts, apparel, and tacky souvineers are where bands make their money. NOT from record sales. By the time the record company is done screwing over artists - they are lucky if they see $0.50 per album.
Now, you take the countless dollars most labels spend on promoting artists - and figure that COULD be going into the artist's pocket. The internet allows for cost free promotion, the same as the radio or MTV does.
The record company is the one that usually leaks the stuff on to the internet anyhow. For example: Allegedly, Hackers hacked into the record company and put Eminem's album on the internet?
What - do they just have the files (in MP3 format of course) lurking somewhere on a random unprotected server? :rolleyes:

i've seen a few places saying that xbox will read a couple of specific brands of cdrs, but i don't care enough about it to go an hunt down something like that when i can just use an rw over and over.
I have just finished studying web design and im starting my own business. So now that im going into business im having to spend $1500 (australian) on studio MX, which, yes is out of my price range but if u get caught using cracked software for commercial gain the consequences are far greater than the 1500 for the software.
