We generally avoid anyone pretending to be a company or a studio who is in fact a one person shop.
Either get a DBA..or bill yourself as a freelancer.
The moment a designer has us enter into a contract with their business name..such as "Whatever Designs" and then tries to get the check switched to a personal name..a huge flag goes up.
We have a lot more respect for designers who simply present themselves exactly as they are, rather than what they want to be.

Agent_Coop is right. It's generally a bad idea to pretend to be a company when you aren't. It can even cost you clients because it harms the client's trust in you. If you aren't truthful with them about who you are, you can't expect them to trust your work.

Absolutely..
Sometimes I'm even more inclined to go with particular freelancers simply because I know their not paying for all of the overhead of a design studio or company.

It is a company, I am not a freelancer. I have partnered up with a 'freelance' hosting and I have others that work with me on the sites we create...

Ok, then you have a DBA..otherwise the company name is exactly your name..and not "Whatever Design"....
In this day of age "partnering" with a freelance site often means signing up for elance.com or other freelance portal, so.. sorry if the business world looks for something solid and referencible.

We don't have DBA yet... I am still looking and understanding this better... There is about 5 of us right now, and why call it "Name 1 & name 2 & name 3 & name 4 & name 5 web design"? We called it "Sensation Designs" instead.

Setting up a DBA at your bank will let you accept cheques signed to "Sensation Designs". Keep in mind though that setting up a DBA doesn't officially register your business name. You have to register it with the government for it to be totally official. I've dealt with DBA's a little. I live in Ontario as well.

You can call it whatever you want....you asked a question pertaining to legal entities & business.
We write contracts which conform to US & Canadian law all the time..that's one of our areas of knowledge. We also purchase about $40,000/yr US in Freelance and Development services, so you are getting that end of it too.

As obvious as it sounds it's totally true though and is overlooked quite a bit. A good example of this in our industry is a business that only offers Flash web design. How effective is that? It's not, and the business won't stay afloat very long because they simply aren't offering a service that is widely requested.

The points about representing yourself as you really are, in the legal sense of the word, is very relevant if you hope to get any "professional" work, rather than just the neighbourhood business or your best friend's father's business site.
If you represent yourself as "ACME Design" then you have to be able to invoice and accept payment as "ACME Design", otherwise no real business will take you seriously. Also if you produce any contracts or documents with "ACME Design" on them they are worth nothing.
A group of freelancers working together is a group of freelancers. They're not a company until they register one.
Simple, and listent to the people making the points here. Most are from the side of business that either work in this area, or more importantly employ those that do.

bottom line is that is costs a surprising amount of money just to start up a small business. it is not just getting a certain type of bank account.
I am quessing that you do not have professional guidance in the form of a gestor (i do not remember this name in english). a gestor is a business that deals with all the paper work, taxes and accounts, has a legal department, and generally helps you get professional.
get one. i highly recommend it.

There are plenty of companies who specialise in just 1 or 2 areas and are very successful at it. Its the ones that say that they can do everything that I'm weary of - some people spread themselves too thin. I think its better to be great at one thing than to be average at a few.
