I have a question with any export for Flash 4 and 3D max
What do you think it is the best way for importing animation or the modelling from 3D max to flash 4

You can only export to ai files if you only use spines.
If you want to use any other method... which most likely you will, you can get either Illistrate!, or Vecta 3d to export into swf files. Neither support shading, but they do a good job.
If you want the texture shading, you can export a .3ds file from 3d studio max, then import into Vecta 3d standalone, or Swift 3d. They will export swf files with full shading. I would recommend Swift 3d over Vecta 3d anyday.
